has submitted a new divorce filing following her split from .
According to court documents obtained by Us Weekly on Friday, November 22, Mellencamp, 43, has decided to change her position on matters surrounding the children’s custody.
When the former Real Housewives of Beverly Hills star initially filed for divorce, she asked for sole physical and legal custody with Arroyave, 47, having “reasonable and frequent” visitation. Now, Mellencamp is seeking joint physical and legal custody of their three children: Slate, 12, Cruz, 10, and Dove, 4.
Mellencamp’s latest filing maintains that the legal grounds behind the divorce were irreconcilable divorces. She also relisted the date of separation as October 20.
When Arroyave filed his response to the divorce earlier this month, he listed the pair’s date of separation as November 1. He also asked for joint legal and physical custody of their three children. (Arroyave is also the father to daughter Isabella from a previous relationship.)
“Edwin and Teddi have always wanted to keep this amicable for the children,” a source told Us Weekly.
And while one insider added, “Teddi and Edwin both knew each other were filing — it was not a surprise,” a separate source claimed Arroyave was “blindsided” when she took legal action.
Us Weekly has reached out to Mellencamp and Arroyave’s teams for comment.
Mellencamp first confirmed on November 2 that she was filing for divorce after 13 years of marriage. At the time, she wanted to speak out to “protect my family from undue speculation and rumors.”
“My priority is my children and ensuring that every care is taken with their privacy and wellbeing throughout this new chapter,” she wrote via Instagram. “I felt being open, honest and vulnerable was the best path forward.”
It wasn’t long before Mellencamp’s divorce, however, sparked more headlines after Us confirmed the “Two T’s in a Pod” podcast host had an affair with her horse trainer, Simon Schroeder, months before separating from her husband.
A source previously told Us that Mellencamp and Schroeder “had a thing several months ago but it’s not still happening” and they are not together.
The same source claimed that Mellencamp and Arroyave worked on their relationship before ultimately deciding to go their separate ways and noted that before Mellencamp’s affair with Schroeder, Arroyave had previously been unfaithful during their marriage. (A second insider, however, previously claimed that Arroyave was “unfaithful” eight years ago but he “insists he has not had an affair since.”)
“Teddi and Edwin’s marriage did not end because of infidelity on Edwin’s behalf,” the insider said, “but rather the affair between Simon and Teddi.”
As new information come out about the pair’s marriage, it appears their love story included peaks and valleys before divorce was the only way forward.
“It was a long time coming and they have been up and down for the last seven-plus years,” a source close to Mellencamp previously told Us. “This isn’t the first time Teddi has wanted a divorce, and it has been an ongoing conversation between them for years.”
The insider noted that the now-exes “have been in therapy over the years and make it work” before agreeing that “they are better as coparents and can be amicable moving forward.”
