’s estranged husband, , has broken his silence after she confirmed their separation.
Arroyave, 47, filed a response to Mellencamp’s divorce docs on Friday, November 8, requesting that the court enforce their prenup. “Pursuant to the parties’ Premarital Agreement, all assets, income from all sources, and obligations of each party are his/her separate property, except as specifically set forth therein,” read his legal docs, obtained by Us Weekly.
The docs continue: “The full nature and extent of [Arroyave’s] separate property is not fully known to [Arroyave] at this time. [Arroyave] will amend this Response and/or file and/or serve appropriate further pleadings to set forth any additional information at a later time as more information becomes available to him.”
Contrary to Mellencamp’s divorce filing, Arroyave’s response lists the pair’s date of separation as November 1, 2024, as opposed to October 20, 2024. He is also seeking joint legal and physical custody of their three children — Slate, 12, Dove, 4, and Cruz, 10 — while Mellencamp, 43, is asking for primary custody. (The businessman is also father to eldest daughter Isabella from a previous relationship.)
Mellencamp announced her plans to file for divorce on Saturday, November 2.
“After a great deal of care and consideration, I have made the difficult decision to file for divorce,” the Real Housewives of Beverly Hills alum wrote via Instagram. “My priority is my children and ensuring that every care is taken with their privacy and wellbeing throughout this new chapter.”
She concluded, “Making a public statement is not something I wanted to do, but in an effort to protect my family from undue speculation and rumors, I felt being open, honest and vulnerable was the best path forward.”
Less than one week before Mellencamp shocked Bravo fans with her split announcement, she had Arroyave by her side while cohosting the Cure Melanoma gala.
“I always say life and pain are inseparable and to see @teddimellencamp embrace her pain and use it for the greater good again last night as she emceed the @curemelanoma gala, was a beautiful reminder of what she is capable of,” he wrote via Instagram on October 27. “Her story has already saved lives. And I couldn’t be prouder that she will continue to save more. Love you, Teds.”
Several months earlier, Arroyave marked their 13th wedding anniversary.
“Thirteen years ago I married who I thought was the woman of my dreams, but as the years have gone by I’ve realized she’s not just the woman of my dreams, she’s also the mother of my dreams, the wife of my dreams and the love of my life,” he penned in July. “Plus, she keeps a mean calendar. Thank you for all that you do for me and our family. I love you, @teddimellencamp.”
The pair nearly separated in 2017 during Mellencamp’s first season of RHOBH. (She was a Housewife for seasons 8 to 10.)
“When we first started, I remember my first day honestly it was like ‘F—, at what point do I tell everybody that I’m getting a divorce? Like when do I do this?’” Teddi told during a March 2023 episode of their “Two Ts in a Pod” podcast. “We are at our worst absolute phase, because truthfully, for us, it was really about a power struggle.”
She continued at the time, “We were always kind of equals when we were together. I rode horses, I was competitive and I was all these things. Then I couldn’t get pregnant naturally, I did all these IVFs. Then, all of a sudden, he was in charge of our finances, and I had never been that. I never not had my own money, I had been working since I was 17. Then I just started hating him.”
As she explained, it took better self-love and communication to work through the issues.
Earlier this month, a source exclusively told Us that the duo’s split had been “a long time coming,” as they “have been up and down for the last seven-plus years.” The insider noted that they “have been in therapy over the years” but ultimately agreed “they are better as co-parents and can be amicable moving forward.”
