Diddy's Lawyers Claim His Rights Were Violated With Jail Cell Search
legal team is claiming that a recent search of the music mogul’s jail cell violated his right to attorney-client privilege.
Diddy, 55, is currently incarcerated at Brooklyn’s Metropolitan Detention Center while he awaits trial on federal sex trafficking charges. Days after prosecutors claimed in a Friday, November 15, legal motion that Diddy tried to obstruct an investigation by contacting witnesses while in jail, Diddy’s lawyers fired back.
“Defense counsel has recently learned that the prosecutors are in possession of attorney client privileged material, including the defendant’s own written notes. This search and seizure are in violation of Mr. Combs’ Fourth, Fifth and Sixth Amendment rights,” lead attorney argued in a letter submitted on Monday, November 18.
In court documents obtained by Us Weekly, Agnifilo asked for an “immediate evidentiary hearing” to investigate the search, which he called a “targeted seizure” that amounts to a “substantive due process violation.” He requested that it be determined “who authorized a search of Mr. Combs’ sleeping area, personal effects and paperwork” and “who determined what paperwork” be handed over to the United States Attorney’s Office.

However, Subramanian […]Agnfilo further claimed that Diddy’s legal team was not aware that the musician’s written notes were taken from his cell and given to prosecutors until the prosecution filed a motion on Friday accusing Diddy of attempting to influence the outcome of his trial. Prosecutors cited a review of recorded calls from Diddy in Friday’s legal filing, claiming that the rapper made “hundreds” of calls and texts in violation of jail rules using telephone accounts belonging to other inmates.
Paras Griffin/Getty Images for Revolt“Since the defendant has been detained at MDC, he has continued to try to evade law enforcement monitoring, corruptly influence witness testimony, and further attack the integrity of these proceedings,” the court documents, obtained by CNN, read. “While attempting to evade law enforcement monitoring, the defendant has, among other things, orchestrated social media campaigns that are, in his own words, aimed at tainting the jury pool; made efforts to publicly leak materials he views as helpful to his case; and contacted witnesses through third parties.”
Diddy was arrested and charged on counts of sex trafficking, racketeering, conspiracy and transportation to engage in prostitution in September. A 14-page indictment accused him of hosting “elaborate and produced sex performances” called “Freak Offs” and alleged that he used “force, threats of force and coercion to cause victims to engage in extended sex acts with male commercial sex workers.”

The prosecution made its recent claims about Diddy attempting to “corruptly influence” the outcome of his trial when arguing that his fourth bail request should be denied.
Diddy and his legal team proposed the new $50 million bail package earlier this month, arguing that he should be allowed to prepare for his May 2025 trial outside of jail due to changed circumstances and new evidence. The filing proposed a “far more robust” bail package with home detention, around-the-clock security monitoring and restrictions on Diddy’s ability to contact anyone but his legal team. A ruling on the fourth bail attempt has not yet been made.
