Second Court rules to deny Asian American appeal in a lawsuit against LVS that goes back to the origins of gaming liberalization

Jorge Menezes

The Court of Second Instance (TUI) denied Asian American Entertainment Corporation (AAEC)’s appeal against the basic court’s ruling and upheld it.After a court of first instance (TJB) ruled in April 2022 against granting AAEC the right to claim damages from Las Vegas Sands, AAEC appealed against this judgment to the Court of Second Instance (TUI), There were some other appeals by AAEC and LVS filed during the proceedings that had not been decided. The second court also ruled that the other, previously filed appeals by both parties did not need to be ruled upon, because the AAEC’s appeal against the April 2022 court of first instance’s judgment has now been decided.According with its lawyer, Jorge Menezes, AAEC will file an appeal to the Court of Final Appeal.AAEC shall request leave to appeal in 10 days, since the TSI decision, which is mandatorily granted by law. This After the court of second instance notifies AAEC that the appeal has been accepted, AAEC has 30 days to file its statement on the grounds of appeal and LVS will have 30 days to file its counter statement of appeal.

Jorge Menezes told the Times Friday, “You I have not yet seen a copy of the second instance’s judgment, so I don’t know what the reasons underpinning the judgment are.”

“I can assure you that we will find until the very end. We can’t see a reason that could justify denying AAEC’s appeal after the errors found in the court of first instance’s judgment issued two years ago. Therefore, we will stretch our right foot and accelerate at maximum strength, added.

Since both parties’ statements of appeal to the court of second instance were written in Portuguese and the judges of the court are bilingual, “I am pretty sure that the judgment will be written in Portuguese, which is an official language in Macau,” Menezes said.

The lawyer, who was Macau Daily Times’ Person of the Year in 2018, refused to comment on the case itself.“I will not comment on the contents of the case.”
